Liability Waiver for Eastside Westside Music Together Classes
COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY. As a willing participant in Music Together® classes at Eastside Westside Music Together, my family and I agree to the following:
ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Eastside Westside Music Together, and present an inherent risk that cannot be eliminated. I acknowledge that, although Eastside Westside Music Together is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including Music Together® teachers, and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children, including all adults, and children two or older, wearing masks when arriving to, departing from, or leaving the family "spot" at any time during, class. All family members must stay within their personal area and ensure that personal instruments/props are not shared between families. I understand and agree that as a registered family with Eastside Westside Music Together, I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19 and other diseases.
WAIVER OF LIABILITY: I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant not to sue Eastside Westside Music Together and its owners, managers, contractors, members, employees, agents, and volunteers, or the location owner (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. In addition, I also assume the inherent risk of being outdoors with my children including but not limited to ticks, bees/yellowjackets, insects, poison ivy, or other outdoor hazards. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.
I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT EASTSIDE WESTSIDE MUSIC TOGETHER, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.
Terms and Conditions
The following Terms and Conditions apply to all programs as described below, upon competing an online registration or registering manually through the office.
Registration & Re-Enrollment: You agree to allow Eastside Westside Music Together to accept verbal authorization from you, for additional registrations in the future by phone or email in lieu of an online registration. By providing your payment information and/or creating a payment profile, you authorize Eastside Westside Music Together to bill you for the classes and/or membership fees.
Payment of Fees and Acceptance of Policies and Procedures: Tuition must be paid by automatic credit card payment. All charges will appear on your credit card statement as being from Eastside Westside Music Together, Inc. Providing ESWS Music Together with your payment information by phone, email, in-person, or by any other means indicates acceptance of all policies and procedures herein listed. Attending any ESWS Music Together classes indicates acceptance of all policies and procedures herein listed.
Membership Cancellation: Members may request to cancel their membership by contacting ESWS Music Together. A Minimum of 31 days notice is required. If a family decides to join classes again, the initial fee will be charged.
Membership Freeze: Members may request to freeze their membership 31 days in advance by contacting ESWS Music Together. While we can not save a spot in the original weekly class, we will do everything possible to accomodate your family when you resume your membership.
Class Cancellations: Sometimes classes don’t fill up the way we would like. ESWS Music Together reserves the right to cancel classes due to low enrollment. In such a case, a refund for unused classes will be given. In the event that a charge is made to an account in error, ESWS Music Together will refund the amount within 60 days by returning the amount to the account billed, or by check, at the discretion of the director.
Make-up/Bonus Classes: Families are entitled to unlimited make-up and bonus classes with your membership. All makeups/bonus classes must be scheduled online via our Makeup Scheduler so we don’t overcrowd classes. No refunds are given for missed classes.
Curriculum Fee: Music materials (songbook, CD/download code) are not returnable once they have been received. If a family chooses to withdraw they will be charged a curriculum fee (currently $44) and may keep their materials.
Parents’ Responsibility to be aware of Dates and Events: It is the responsibility of the parent to be aware of all session dates and holidays. ESWS Music Together will post all such notices on our website and in the Family Portal. We will send notices/email/text messages home, when appropriate. It is the parents’ responsibility to regularly check these media to ensure they are informed. It is the responsibility of the parents to inform the school of any address or telephone number change.
Extreme Weather or Unexpected Interruption of Classes: If ESWS Music Together must cancel classes due to extreme weather or events beyond our control such as power outages, the missed classes will be added on where possible. No refunds due to these reasons will be given.
Injuries: Parents, legal guardians of minor students and adult students waive the right to any legal action for any injury sustained at ESWS Music Together venues resulting from normal class activity or any other activity conducted by families before, during, or after class time.
Media Release: ESWS Music Together and its business affiliates are hereby granted permission to take photographs and audio-visual recordings of the students in classes and other related events to use in brochures, web sites, posters, advertisements and other promotional materials that ESWS Music Together creates. Permission is also hereby granted for ESWS Music Together to copyright such photographs in its name.
Privacy: ESWS Music Together does not sell or give personal information to third parties without express consent. ESWS Music Together will use your personal contact information for:

By enrolling in a Music Together class at ESWS Music Together, a licensed Music Together center, you agree that any information you provide will be shared with Music Together Worldwide (MTW). For information about how MTW uses and stores your personal information, we encourage you to review the Music Together Worldwide Privacy Policy.
Policy and Procedure Changes: These Policies and Procedures are subject to change at any time, and the most recent version of them will be posted to our website. All registered parties agree to the terms herein, as well as changes to these policies when posted to the website by signing and/or registering and re-registering by phone.
